Анотація
У статті досліджуються особливості суб’єктного складу, істотні умови та юридична характеристика договору аутстафінгу. На підставі проведеного аналізу автором надається власне визначення поняття договору аутстафінгу. In the article special features of subjects, essential conditiones and juridical characteristics of outstaffing agreement have been defined, which is the aim of the article. Having finished the analysis of juridical construction mentioned the author gave his own definition of outstaffing agreementwhich is new legal institution for national judicial system and enforcement practices: according to outstaffing agreementa contracting party (employer) who had entered into a labour contract with an employee transmites the employee to another party of oustaffing agreement (individual person, contractor) for a specified period or without any period and for a charge with the aim of the employee to carry out a labour function mentioned at the outstaffing agreementat another individual person (persones). Doing the research the author used developments made by another national scientists whose scientific interests connected with outstaffing agreement. By the author’s point of view essential conditiones of outstaffing agreement are: subject, purpose and labour function, period of validity and a contract price. It is notable about dual nature of subject of an outstaffing agreement: juridical (activities about transferring/receiving employee) and so called «material» subject – the employee. In author’s opinion, commercial outstaffing agreement can’t be conducted but civilian only instead. The research made by the author is useful for doing further researches about outstaffing agreement.
