Анотація
У статті здійснюється порівняння законодавства України та Федеративної Республіки Німеччини щодо правового регулювання спеціальнх засад призначення покарання. Проводиться науковий пошук у законодавстві Німеччини аналогів сеціальних засад призначення покарання, які окреслені українським закондавством. The article compares the legislation of Ukraine and the Federal Republic of Germany on the legal regulation of special principles of sentencing. There is a scientific search in German law for analogues of the social principles of sentencing, which are outlined by Ukrainian law. The Criminal Code of the Republic of Germany is studied as a normative legal act regulating the procedure for sentencing. There is a separate legal act on the legal regulation of sentencing minors. Differences in the legal regulation of certain rules of sentencing under the laws of Ukraine and Germany were revealed. There is a variety of approaches to establishing mitigation approaches in the legislation of the studied states. It was found that in the German legislation there are no special principles of sentencing in the usual sense. It has been determined that the main tool in ensuring the individualization of punishment in Germany is judicial review. It is stated that it is impossible to implement the German experience in Ukraine in modern conditions.
