dc.description.abstractМетою статті є характеристика свободи волі сторін трудового договору як категорії, що є провідником до стабільності трудових правовідносин. Розглядаючи наукові дослідження з питань зміни трудового договору, автор наголошує, що в умовах необхідності прийняття нового кодифікованого акта, що врегулює відносини у сфері найманої праці, головний акцент має бути зроблено на вирішенні питань свободи волі сторін у зміні трудового договору таким чином, щоб віднайти баланс їхніх інтересів. Відстоюється позиція, що зміна трудового договору є правовою конструкцією, яка має за мету вдосконалення організації виробництва й праці. Робиться висновок, що свобода волі сторін трудового договору як провідник на шляху до стабільності трудових правовідносин характеризується збігом векторів бачення цих суб’єктів на зміст нових умов їхньої взаємодії. The purpose of this article is to characterize the free will of the parties to the employment contract as a category that serves as a guide to the stability of labor relations. Considering the existing research on changes in the employment contract, the author emphasizes that in the event of the need to adopt a new codified act regulating relations in the field of employment, the main emphasis should be on resolving the issues of freedom of will of the parties to change the employment contract. their interests. The position is defended that the change of the employment contract is a legal construction which has the purpose of improvement in the organization of production and work. It is concluded that the free will of the parties to the employment contract as a guide to the stability of labor relations is characterized by the coincidence of the vectors of vision of these entities on the content of the new conditions of their interaction. The choice of the parties to the employment contract, from the proposed current legislation, the variant of their behavior, which is focused on a promising relationship within the existing employment relationship, but in a new capacity and the manifestation of their will as a result determines the transition to a new level, that with the stability of labor relations will allow these parties to show their creativity and find a balance of interests.uk_UA.UTF-8
