Анотація
Метою наукової статті є аналіз новел національного законодавства, які регулюють питання примусового відчуження майна в умовах режиму воєнного стану. Автором здійснюється дослідження змісту принципу непорушності права власності та обrрунтовується необхідність неухильного дотримання його елементів у процесі визначення меж допустимого втручання з боку держави під час бойових дій. The purpose of the scientific article is to analyze the novelties of the national legislation, which regulate the issue of forced alienation of property in the conditions of the introduced martial law regime. The author conducts a study of the content of the principle of inviolability of property rights and substantiates the need to strictly observe the elements of this principle when determining the limits of permissible interference by the state during hostilities. Given the fact that the expropriation of property implies negative consequences for the right to private property of ordinary citizens, today all legislative initiatives and innovations that are designed to directly or indirectly provide legal regulation of this range of pressing issues deserve special attention. The principle of inviolability of the right to private property is established at the constitutional level, therefore, the use of such exceptional methods of termination of property as compulsory alienation of property, which must have a clear, complete and specific legislative justification.
