dc.description.abstractМетої статті є характеристика концепту «право на безпечні і здорові умови праці» як складової гідної праці в Україні в реаліях режиму воєнного стану та визначення індикаторів-умов, що є прийнятними для відхилення від його змісту – європейського стандарту під час режиму воєнного стану. Автор констатує, що кількість заходів, непопулярних для працівників, але популярних для роботодавців, є занадто великою для малостатейного Закону України «Про організацію трудових відносин в умовах воєнного стану». Фактично новий спеціальний нормативно-правовий акт закріпив пріоритет прояву свободи волі роботодавця у питаннях правового регулювання трудових відносин за рахунок обмеження трудових прав працівника. Автор дійшов висновку, що держава, використовуючи обмеження на трудові права в реаліях режиму воєнного стану, має чітко визначати умови-індикатори використання такої можливості, не нехтуючи напрацюваннями щодо забезпечення гідної праці. Надаються пропозиції із вдосконалення чинного законодавства. The realities of the war, in which the Ukrainian state found itself as of February 24, 2022, forced to reorient the legal regulation of social relations to a military manner. The law not only fixes the existing state of things, offering a valid arrangement, but also forms a roadmap to a certain result: maintaining the provision of decent work, in particular through the legal foundation of creating safe and healthy working conditions in the harsh realities of today and in the future. The purpose of the article is to characterize the concept of "the right to safe and healthy working conditions" as a component of decent work in Ukraine in the realities of the martial law regime and to determine the indicators-conditions that are acceptable for deviation from the fulfillment of this concept - the European standard during the martial law regime. The author states that the number of unpopular measures for employees, but popular for employers, is too large for the low-sex Law of Ukraine "On the Organization of Labor Relations in Martial Law". In fact, the new special normative legal act established the priority of the manifestation of the employer’s freedom of will in matters of legal regulation of labor relations at the expense of limiting the labor rights of the employee. It is concluded that the state should, using restrictions on labor rights in the realities of the martial law regime, clearly define the conditions-indicators for the use of such an opportunity, not neglecting the work on ensuring decent work. Suggestions for improving the current legislation are provided.
