    Місце прокуратури в системі органів державної влади

    В статті проаналізовано місце прокуратури в системі органів державної влади України. Автор робить висновок, що прокуратура як орган державної влади на сьогодні є, з одного боку, незалежним органом державної влади, з іншого боку, введення її легітимізації в Розділ VIII Конституції «Правосуддя» не є випадковим. Законодавець таким чином натякає про подальший курс реформування судової гілки влади й прокуратури у бік віднесення останньої до судової гілки влади. Автор вважає цей крок суперечливим, а нинішню правову конструкцію більш доречною. The article analyzes the place of the prosecutor's office in the system of state authorities of Ukraine. The author concludes that the prosecutor's office as a body of state power today is, on the one hand, an independent body of state power, on the other hand, the introduction of its legitimization in Chapter VIII of the Constitution "Justice" is not accidental. In this way, the legislator hints at the further course of reforming the judicial branch of power and the prosecutor's office in the direction of bringing the latter into the judicial branch of power. The author considers this step controversial, and the current legal structure more appropriate.
