Анотація
Розглянуто питання щодо правових проблем користування надрами в Україні та видів надрокористування. Наголошується на необхідності вдосконалення природоохоронного законодавства України. Окрему увагу приділено питанням користування надрами без спецдозволу та гірничого відводу землевласниками та землекористувачами. Рассмотрены вопросы правовых проблем пользования недрами в Украине и видов недропользования. Подчеркивается необходимость усовершенствования природоохранного законодательства Украины. Отдельное внимание уделено вопросам, касающемся пользования недрами без спецразрешения и горного отвода землевладельцами и
землепользователями. Due to the constant changes in the legislation of Ukraine on subsoil use, today
there is a situation that the current regulations governing legal relations in the field of subsoil use
are chaotic, outdated, contain many conflicting rules, and most importantly do not meet modern
realities and European standards.
Therefore, the purpose of this article is to highlight the existing problems of subsoil use in
Ukraine, their legal analysis and justification of the need for some changes in current legislation.
In particular, this applies to the issue of subsoil use without a special permit and mining
allotment by landowners and land users.
Thus, the Subsoil Code exempts the landowner / land user only from obtaining a special
subsoil use permit and mining allotment, but does not exempt from obtaining other permits.
Instead, the Land Code prohibits the use of land for other purposes. In this case, the owner
of the land plot or the land user may demand the elimination of any violations of his land rights,
even if these violations are not related to the deprivation of the right to own the land plot and
compensation for damages. That is, in these cases there are conflicts of legal norms, and therefore, summarizing the above, the existing legal inconsistencies in the current regulations of current
legislation of Ukraine governing legal relations on land use and subsoil use, today lead to a vicious
circle to address these situations, and therefore need immediate legal settlement
